Lawyer Reacts To Court Decision Dismissing Suit Against FMC Medical Director, Musa - Olomu

Human rights lawyer, Isaac Izunya, on Monday clarified the position of a Federal High Court sitting in Abeokuta on a suit instituted by a non-governmental group, (Youths Reoriented  Initiative of Nigeria AYRION) against the Medical Director of Federal Medical Centre Abeokuta, Ogun State, Prof. Adewale Musa-Olomu.

The suit by the AYRION, which challenged the appointment of Prof. Adewale Musa-Olomu as Medical Director of the specialist health care facility, was on Thursday, March 17, thrown out for impropriety and lack of locus standi on the part of the applicant.

Also, the trial Justice (Mrs) O.O  Oguntoyinbo in her 30 pages judgment who dismissed the case with suit number FHC/AB/100/21" in its entirety,"  held that the applicant failed to show reasonable cause of action that the suit falls under public interest.

But addressing newsmen in Abeokuta, the state capital, Izunya argued that the decision of the court given on March 17, is not on the merit of the case regarding the prayers sought.

The Counsel explained that the Court decision on the matter did not address whether the second respondent(Prof. Adewale Musa-Olomu) abused his office, has plenty of names on his certificates or has attained retirement age in civil service.

He said: "I am of the form believe that this press release will serve as a compass to guide the press and members of the public who were not in the court when the judgement was delivered and do not have access to the judgement to know the kind of comment to make about the judgement; for instance, the court awarded against the Applicant the cost of N100,000 (One Hundred Thousand Naira) each in favour of 1st and 2nd respondent, only for a radio station in Abeokuta to report to the general public that the court awarded cost of One million naira against the Applicant. Another quarter reported that it was only N100,000 (One Hundred Thousand Naira) that awarded against us.

"In conclusion... I want to use this medium to draw our attention to the fact that the applicant is Non - Governmental Organisation birthed into existence to among others, defend the future future of the Nigerian youth by fighting corruption in public places, defend the defenceless and re-orient the youth to meet up with the global standard of reasoning and activities.

"In order to achieve this aim, we are appealing to members of the public who believes in our goal to support us, especially the present cost awarded against the u organization, because if didn't pay the cost it will be a disobedience to the order of the court, and God forbid that a lawyer will be party to disobedience to Court's order."

Earlier, the lead defence(respondent) counsel, Barr Kunle Kalejaiye(SAN) had lauded the judgment, describing it as a " triumph of truth over falsehood.

"You don't build something on nothing.
What happened this afternoon is to illustrate the fact that truth has caught up with falsehood,"  Kalejaiye said.

Also commenting at the time, the highly elated Medical Director, said he was happy about the verdict.

" I am extremely  happy that God had ultimately allowed justice to prevail

" I have repeatedly said it that this administration stands for justice. The Court has spoken and we're grateful unto God  for that" Prof  Musa-Olomu remarked.

He thanked all his admirers and well wishers who stood solidly behind him while the legal battle lasted.
